Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website at gamevaultstudios.com and any games, applications, or services provided by SureSignal Technologies LLC, doing business as GameVault Studios ("GameVault", "we", "us", or "our") (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement of a parent or legal guardian.
2. Accounts
Some features require you to create an account or sign in using a third-party identity provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
3. License to Use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. All rights not expressly granted are reserved.
4. Acceptable Use
You agree not to:
- Violate any applicable law or regulation
- Infringe the intellectual property or other rights of any party
- Reverse engineer, decompile, or attempt to extract source code from the Services, except as permitted by law
- Cheat, exploit bugs, use automation or bots, or otherwise interfere with fair play or the normal operation of the Services
- Harass, abuse, or harm other users
- Upload or transmit malicious code or content
- Attempt to gain unauthorized access to any portion of the Services or related systems
5. Virtual Items and In-App Purchases
The Services may include virtual currency, virtual goods, or other in-game items ("Virtual Items"). Virtual Items have no real-world monetary value, are licensed (not sold) to you, and are non-refundable except as required by applicable law. You may not sell, trade, or transfer Virtual Items outside of the Services. We may modify, manage, or eliminate Virtual Items at any time. In-app purchases are processed by the platform operator (e.g., Apple) and are subject to their terms in addition to ours.
6. User Content
If the Services permit you to submit content (such as display names, profile information, or messages), you retain ownership of that content but grant GameVault a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display it solely to operate and improve the Services. You represent that you have all rights necessary to grant this license.
7. Intellectual Property
The Services, including all content, software, graphics, text, and trademarks (other than User Content), are owned by GameVault or our licensors and are protected by intellectual property laws. "GameVault" and "GameVault Studios" are trademarks of SureSignal Technologies LLC.
8. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will cease immediately. Sections that by their nature should survive termination will survive.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEVAULT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless GameVault and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Washington, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
